What if my Application is Denied or Ignored?

If an application for license to carry is denied, an applicant wishing to contest the denial must file a petition for review in the local district court within 90 days of the denial. If an application for license to carry is not acted upon within 40 days of filing, an applicant wishing a license must file a petition for review in the local district court within 90 days following the expiration of the 40 days (unless the license is issued within the 90-day period and prior to filing a petition). Thus, one applying for a license to carry should make a calendary entry for approximately 120 days following the date of the application: If by that date the application has not been acted upon, the applicant should attend to the process of filing a petion in the district court. Note that the full 130 days to appeal following application without any action on the application may be longer than the period to appeal in the case of denail--the peiord following denail being 90 days following the denial, which denial may occur prior to 40 days after filing the application, triggering the petition|appeal period, in which case the peition|appeal period will be less than 130 days.
